In this appeal by a defendant who was convicted of sexual battery and lewd and lascivious molestation of his daughter, we have occasion to consider the proper use of out-of-court ex parte statements. Defendant argues that the States principal evidence of the crime--a video statement of the victim--failed to satisfy the requirements of the Confrontation Clause of the United States Constitution as recently explicated in Crawford v. Washington, 541 U.S. 36 (2004). We agree and reverse.
